Subcontracting plan and declaration

What this is

A short document that sets out the economic operator’s planned use of subcontractors, describes how they will be managed, and provides the mandatory self‑declarations required by EU public procurement law.

When you need it

You must submit this as part of the tender dossier when the contracting authority requires information on subcontracting (usually at the selection stage and again before award). It is also needed for any dynamic purchasing system where subcontractor details are requested.

How to fill it in

1. Identify required sections – check the tender pack for:
2. The ESPD self‑declaration form (Article 59) – usually a separate annex.
3. Any specific subcontracting questionnaire supplied by the authority.
4. List each planned subcontractor and provide:
5. Full legal name and address
6. VAT / tax identification number
7. Description of goods/services to be provided
8. Estimated share of the total contract value (percentage or € amount)
9. Provide evidence of compliance – attach copies of:
10. Relevant certificates (e.g., ISO 14001, social‑labour standards, environmental licences).
11. Proof of financial standing (annual accounts, bank guarantees) if requested.
12. State the payment mechanism – indicate whether payments will be made directly to subcontractors (Article 71) and describe any safeguards (retention funds, escrow accounts).
13. Sign and date – an authorised representative must sign the declaration, confirming that all information is accurate and that the operator will enforce the obligations of Article 18(2) on its subcontractors.
