Consortium / joint venture agreement outline

What wins points

A complete consortium description that meets ESPD (Art 59) and award‑criteria (Art 67) requirements demonstrates financial and organisational capacity, giving evaluators confidence and improving score on technical criteria.

What gets bids disqualified

Missing partner details or lacking financial evidence triggers exclusion grounds (Art 57) and ESPD rejection (Art 59), leading to immediate disqualification.

Evaluator's view

Evaluators first verify that all partners are listed with full legal, financial and liability information before assessing the consortium’s overall suitability.

Consortium / joint venture agreement outline

What this is

A concise template that sets out the essential information required to describe a consortium or joint‑venture structure for a public procurement contract.

When you need it

Use whenever the tender documentation asks for details of a group of economic operators (e.g. joint venture, consortium) – typically at the ESPD stage (Article 59) or when providing the award criteria information (Article 67). In most EU procurements this is mandatory.

How to fill it in

  1. Name of the consortium/joint‑venture – as it appears in the contract documents.
  2. Partner list – for each partner provide:
  3. Legal name and address
  4. VAT / tax identification number
  5. Share of participation (percentage or role)
  6. Relevant certifications or pre‑qualification status
  7. Purpose of the collaboration – short description of why the partners are joining.
  8. Governance structure – indicate decision‑making body, chairperson, and voting rules.
  9. Financial capacity evidence – attach latest audited accounts or bank guarantees for each partner.
  10. Liability arrangement – specify whether liability is joint and several or proportionate to share.
  11. Duration of the agreement – start date and expected end date linked to contract period.
  12. Signature block – place for authorised signatories of all partners.

All information should be copied verbatim from the tender pack where required; otherwise, leave placeholders in square brackets for the contractor to complete.
