What this is

A streamlined acquisition lane for commercially available products and services where the Government uses market‑friendly terms. It is governed by FAR Part 12 and the "Instructions to Offerors—Commercial Products and Commercial Services" clause (52.212‑1)【S15】.

When you need it

Use when the solicitation calls for a commercial acquisition – typically indicated by the inclusion of SF 1449 (or its electronic equivalent) and references to FAR Part 12. It is mandatory for purchases that qualify as commercially available off‑the‑shelf (COTS) items or services, and optional for any other commercial‑type procurement.

How to fill it in

1. Identify the acquisition lane – Check the solicitation’s “Acquisition Strategy” section for a reference to Part 12 or clause 52.212‑1【S15】.
2. Gather required inputs
3. Statement of work / performance work statement (Section L of the solicitation).
4. Pricing data: use market research, catalog prices, or vendor quotes; no cost analysis is required beyond verifying reasonableness under FAR 15.305.
5. Representations & certifications: include SAM registrations and any required certifications per FAR 52.204‑8【S17】.
6. Complete SF 1449 (or the electronic equivalent) – fill in the commercial product/service description, quantity, delivery schedule, and total price. Use the “commercial item” box.
7. Attach clause 52.212‑1 – copy verbatim from FAR § 52.212‑1; do not modify language.
8. Tailor provisions – If the solicitation allows, apply any tailoring under Subpart 12.302 (tailoring of clauses)【S1】.
9. Submit – Ensure the offer is uploaded before the deadline; lateness results in automatic rejection per FAR § 52.212‑1(f).
